Dilapidations

Dilapidations claims are based upon contract law, supplemented by case law and statute. A lease essentially creates a contractual relationship between two parties and a schedule of dilapidations is an allegation of breach of contract, which could result in legal action. The Civil Procedure Rules and the Property Litigation Association's Pre-action Protocol have fundamentally changed the method in which dilapidations are now approached. In our opinion this is not an area of practice for the inexperienced.

As a record of evidence that can be put before the court, the clarity and accuracy of a schedule of dilapidations is extremely important. Our team can act on your behalf in compiling a dilapidation survey and/or Scott schedule at the end of the lease. Our expertise will ensure that you have the best possible advice with regard to remedy and damages.

Stapleton Consulting act for both landlords and tenants for various property types. We have a detailed knowledge of dilapidations law and practice and our constant involvement keeps us at the forefront of current thinking and case law.

Our services include:

  • Break clause experience and advice
  • Providing detailed Schedules of Condition at lease commencement to limit the potential dilapidations liability.
  • Interim dilapidation Schedules
  • Repairs Notices
  • Terminal Schedules
  • Advice to tenants in defending the landlord’s schedule
